Fed-OSHA has halted enforcement and implementation of its controversial COVID vaccine mandate for employers with at least 100 employees. Acceding to a mandate from the U.S. Fifth Circuit Court of Appeals,  to âtake no steps to implement or enforceâ the emergency temporary standard Fed-OSHA affirms that it will obey the order.
Multiple lawsuits filed in nearly every circuit against the Fedâs emergency temporary standard regulation have been consolidated and will be adjudicated by the Sixth Circuit.
âWhile OSHA remains confident in its authority to protect workers in emergency,â it says, the agency âhas suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation.â
The Cal/OSHA Standards Board also has announced it will cease working on a âHorcherâ adoption of the federal ETS while the legal battle plays out.
